Terms of service

The rules for using TKVR, whether you support a creator or run a page. Plain language, under Irish law.

Who we are

TKVR is run by David Ewins, a sole trader in Ireland. "We", "us" and "our" on this page mean him. You can reach us at david@tkvr.me.

These terms cover tkvr.me and the TKVR apps. By using TKVR you agree to them. If you run a page, the Creator terms apply to you as well. Our Privacy policy explains what we do with your data.

Your account

You sign in with your email address and a code we email you. There is no password. Keep access to your email safe, because anyone who can read it can sign in as you.

You must be at least 16 to have an account. To run a page you must be at least 18.

Give us a real email address and do not sign in as someone else. You are responsible for what happens on your account.

Paying a creator

When you join a paid tier, buy a course or book a call, you buy it from the creator, not from TKVR. The payment is made on the creator's own Stripe account, and the creator is the seller. TKVR runs the page and takes a platform fee from the creator.

Stripe handles your card. We never see your full card number. A card you save works on every page you support.

Prices are shown in the currency the creator chose. Your bank may charge you to pay in another currency.

Memberships

  • A membership renews every month until you cancel it.
  • You can cancel at any time from your memberships. You keep access until the end of the month you paid for, and you are not charged again.
  • If you switch to another tier, the price change is worked out pro rata for the rest of the month.
  • A free tier needs no card. To move from a paid tier to a free one, cancel the paid one first.
  • Creators can change what a tier includes.

Paid calls

  • You can cancel a booked call for a full refund, or move it, until 24 hours before it starts. You can move one booking up to 2 times.
  • After that, the call can no longer be cancelled or moved by you.
  • If the creator cancels a call, you always get a full refund.

Refunds

Apart from the call refunds above, refunds for memberships and courses are up to the creator, who is the seller. Ask them first. If you cannot reach them, email us.

If you live in the EU or the UK, you may have a legal right to cancel some purchases within 14 days. Nothing in these terms takes away rights you have by law.

Courses, products and memberships start as soon as you pay. Before you pay, we ask you to tick a box to say you want access straight away and that you understand you then lose the 14-day right to cancel. For a membership, this covers the first month. For a paid call, the box only confirms the time you picked. It takes no right away, and the call refund rule above still applies.

What is not allowed

These rules cover everything on TKVR: pages, posts, courses, chats, calls and livestreams. Do not post, send or sell:

  • anything illegal, or anything that helps someone break the law
  • sexual content involving anyone under 18, of any kind
  • sexual content of anyone without their consent
  • content you do not have the rights to, such as other people's music, films, photos or courses
  • harassment, threats, bullying or hate aimed at people for who they are
  • content that promotes terrorism or violence
  • scams, fake offers, or content that pretends to be someone else
  • other people's private information without their permission
  • malware, spam, or anything that attacks TKVR or its users

Do not copy or share members-only content outside TKVR without the creator's permission.

There is no tolerance for objectionable content or abusive users. We remove content that breaks these rules and remove people who post it.

Reporting content and blocking people

Every post, chat message, page and person on TKVR has a Report option, on the web and in the app. Choose why you are reporting it and add a note if you want. The page owner and TKVR are told straight away. The person you report is not told who reported them.

You can also block anyone. You will no longer see their messages in chats, and neither of you can send the other a direct message. You can unblock people from your account settings.

We act on every report within 24 hours: we remove content that breaks these rules and remove or ban the people who posted it. Page owners can also remove messages and remove people from their community.

You can also report something by email to david@tkvr.me with a link to it and why you think it breaks the law or these terms. This is also our point of contact under the EU Digital Services Act. We look at every report, act on it when it breaks the law or these terms, and tell you what we decided.

We can remove content, and limit, suspend or close accounts and pages that break these rules. When we do, we tell the person affected why, unless the law stops us. If you think we got it wrong, reply to that email and we will look again.

Content belongs to its creator

Creators keep the rights to what they post. Joining a tier gives you access to view it on TKVR for as long as your membership lasts. It does not give you the right to copy, sell or share it.

Our service

We work to keep TKVR running and safe, but we cannot promise it will always be available or free of errors. We may change, add or remove features.

TKVR's code is open source under the GNU AGPL 3.0. That license covers the code, not the content creators post.

Closing your account

You can delete your account from your account page. Cancel your memberships first. If your account runs a page, email us to close it. We may suspend or close an account that breaks these terms.

Liability

We are not responsible for what creators post, sell or promise. Your purchase is with the creator. We are not liable for losses we could not reasonably foresee, or for losses caused by things outside our control.

Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the rights your local consumer law gives you.

Changes

If we change this page, we post the new version here with a new date. If a change matters to you, we tell you by email or in the app before it takes effect.

Law

These terms are governed by the laws of Ireland, and the courts of Ireland can hear disputes. If you are a consumer living in another country, you keep the protection of that country's mandatory laws and can bring a claim in its courts.
